Subject: 20544/FLSA/Fair Labor Standards Act Amended Date: Thu, 7 Jun 1990 12:04:00 -0500 RESOLUTION NO. 20544 A RESOLUTION REPEALING RESOLUTION NO. 19227, ENCAPTIONED AS SET FORTH HEREIN AND ESTABLISHING NEW EXEMPTIONS UNDER THE FAIR LABOR STANDARDS ACT OF 1938, AS AMENDED PURSUANT TO SECTION 2-152(a) OF THE CHATTANOOGA CITY CODE. WHEREAS, Section 2-152(a) of the Chattanooga City Code provides that the governing body of the City of Chattanooga may by resolution declare which employment positions in its opinion are exempt from the minimum wage and overtime provisions of the Fair Labor Standards Act of 1938, as amended; and WHEREAS, by Resolution No. 19227, encaptioned "A RESOLUTION REPEALING RESOLUTION NO. 16470, ENCAPTIONED AS SET FORTH HEREIN, AS AMENDED, AND ESTABLISHING NEW EXEMPTIONS UNDER THE FAIR LABOR STANDARDS ACT OF 1938, AS AMENDED PURSUANT TO SECTION 2-152(a) OF THE CHATTANOOGA CITY CODE" the governing body of the City of Chattanooga declared such positions which in its opinion were exempt from the minimum wage and overtime provisions of the Fair Labor Standards Act; and WHEREAS, the City Council of the City of Chattanooga, Tennessee, has again considered all the various positions of the City Government in light of the exemptions authorized under the Fair Labor Standards Act and does hereby desire to declare which positions are exempt thereunder, 0C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Resolution No. 19227, encaptioned as set forth above, be and the same is hereby repealed.
